We called attention to that fact back in June of 2010 and again a few months ago. Now, I'm reading the comments elsewhere and hearing essentially, "What do you expect from ADC?? This is why people who gave a damn formed Alabama New South Coalition years ago."? Possibly, even probably, true.? But I would just point out that Alabama New South Coalition doesn't appear to have filed any campaign finance reports with the Secretary of State's office since 1999. After the 2010 primary I emailed the contact on ANSC's website to ask about this failure to file.? Crickets.? I also phoned the SoS office to see if there was another ANSC listing ... they couldn't find one. Get with the program folks, get your act together and follow the damned law.? Stop embarrassing your friends.? Did I mention that this does not require a degree in rocket science?

I remember that we spent hours going through the Alabama SOS Web site trying to find these financial disclosure forms a year ago and nobody seemed to think it was a problem.

Now, the ADC finds itself "hoist on it's own petard" and unfortunately the ADP (important difference, that last initial) will probably be hurt more by the failure than the ADC will be.

Is that we heard from several campaign staffers that some of these organizations were essentially extorting "contributions" from candidates -- large contributions -- in exchange for allowing those candidates to speak at their meetings, which is a prerequisite for obtaining the "endorsement" of said organizations.?

Tried to check the ADC/ANSC records to see who had paid and how much ... surprise!? There were no records.? Of course, all the candidates duly filed their reports and reflected the "contributions."

New Calif. political maps to favor Democrats (AP)

SACRAMENTO, Calif. ? A citizens commission established by voters to independently create California's legislative and congressional districts delivered its first set of maps Friday, voting to adopt new boundaries that appear to increase the reach of majority Democrats.

The 14-member California Citizens Redistricting Commission approved final draft versions of district maps for Congress, the state Assembly and Senate, and the state Board of Equalization, which administers sales and use taxes.

Even before the vote, the drafts were being heavily scrutinized by political parties, communities and minority groups because they will be used in state elections for the next decade, helping shape the composition of the 120-member state Legislature and California's congressional delegation, the nation's largest.

Redistricting experts said the new maps are likely to reduce the influence of Republicans even further. Democrats are hoping the redrawn districts will allow them to achieve the two-thirds majority needed in the Legislature to pass tax increases, while the number of Republicans California sends to Congress ? now 19 ? could be reduced by as many as five.

Two of the commission's Republican members, Michael Ward of Anaheim and Jodie Filkins Webber of Norco, voted against the new congressional boundaries.

Ward said the independent panel approved by voters in 2008 was intended to take politics and special interests out of the once-a-decade process of setting new political boundaries, but he did not think that had happened.

"In my opinion, the commission failed to fulfill its mandate to strictly apply the constitutional criteria, consistently apply race and community of interest criteria, and sought to diminish dissenting viewpoints," he said before final votes were taken.

The California Republican Party has said the commission's decisions were not transparent enough and will consider a lawsuit or a ballot referendum.

At least nine commissioners had to support the new boundaries, including at least three each from Democrats, Republicans and independents. The new Assembly, state Senate and Board of Equalization districts were approved 13-1, with Ward dissenting each time. The congressional maps were approved 12-2.

Final certification is due by Aug. 15, allowing time for public viewing and technical fixes.

California Rep. Jeff Denham told a liberal blogger this year ?absolutely? when asked if he thought he?d vote against a debt ceiling increase. New Jersey Rep. Leonard Lance said in a statement on his website that he would ?oppose raising the debt limit without first passing a real balanced budget plan that puts the Nation on a glide path toward fiscal responsibility,? a sentiment echoed by the Republicans who signed the Cut, Cap and Balance pledge.

?Rep. Denham already voted against a clean raise on the debt ceiling. Today he voted to control spending and taxes, reduce the debt on future generations and ensure a balanced budget amendment that will prevent Washington from continuing to spend money it does not have,? Analysts: Senate plan saves $2.2 trillion (AP)

WASHINGTON ? Budget analysts said Wednesday that a Senate Democratic plan to reduce the deficit and increase the nation's borrowing authority would save $2.2 trillion over a decade, more than a rival House Republican proposal but less than promised. With both bills stuck in neutral, Congress, financial markets and the public remained on edge days before the deadline for heading off a potentially calamitous default.

The Congressional Budget Office estimated that the plan by Senate Majority Leader Harry Reid, D-Nev., would result in savings of just over $2 trillion, some $500 billion less than Reid had promised. The Senate bill, however, would save more than a House Republican proposal by Speaker John Boehner, R-Ohio.

Nonpartisan congressional scorekeepers said his proposal would cut spending less than advertised, about $850 billion over 10 years, not the $1.2 trillion originally promised. The estimate, coupled with growing opposition from rank-and-file GOP conservatives, forced Boehner to postpone a scheduled vote on the bill to Thursday.

Republican and Democratic congressional leaders are scrambling to come up with an elusive compromise that could win the backing of President Barack Obama. The federal government faces a first-ever default absent a plan by Aug. 2, just six days away.

The CBO analysis of the Senate plan estimated that it would save $840 billion in non-war spending by government agencies. The analysis said it would reduce the government's interest payments by $375 billion over a decade. The bulk of the reductions would come from projected savings of $1 trillion from winding down wars in Iraq and Afghanistan.

Despite the stalled measures ? and angry partisan rhetoric ? the differences between the sides are narrowing, not widening. Boehner's plan represents significant movement from a bill the House passed last week, roughly half of its mandated spending cuts, for example. And Reid no longer is insisting on having tax increases as part of any plan to cut deficits.

Boehner needs to do more than pump up the legislation. He needs to shore up his standing with tea party-backed conservatives demanding deeper spending cuts to accompany an almost $1 trillion increase in the government's borrowing cap. Many conservatives already had promised to oppose it.

"We need more drastic cuts," said Rep. Jason Chaffetz, R-Utah. "I can't support it in its current form."

"I'm searching for a path toward yes but having a difficult time finding it," said Rep Bill Huizenga, R-Mich.

Unless he can wrestle the situation under control, Boehner risks losing leverage in his dealing with President Barack Obama and Democrats controlling the Senate.

Boehner's plan was not winning converts among some stalwart conservatives. It prompted Reid to declare that the bill was destined to fail in the Senate and it drew a White House veto threat. But it was framing the debate over how to reduce long-term deficits while raising the debt ceiling.

Tuesday's Congressional Budget Office analysis said the GOP measure would cut the deficit by about $850 billion over 10 years, not the $1.2 trillion originally promised. Even more embarrassing was a CBO finding that the measure, which would provide a $900 billion increase in the nation's borrowing cap, would generate just a $1 billion deficit cut over the coming year.

Boehner's plan would couple budget savings gleaned from 10 years of curbs on agency budgets with a two-track plan for increasing the government's borrowing cap by up to $2.7 trillion. The first increase of $900 billion would take effect immediately; the second increase could be awarded only after the recommendations of a special bipartisan congressional panel are enacted into law.

The White House says Boehner's measure would reopen the delicate and crucial debt discussions to unending political pressure during next year's campaigns and risk more uncertainty in the markets.

The White House promised to veto Boehner's measure if it were to reach Obama's desk.

It's unlikely to come to that. Reid, D-Nev., promised the measure would never make it through the Democratic-controlled Senate.

Reid held back on forcing a vote on his competing measure, which he unveiled Monday to poor reviews from Republicans like Senate Minority Leader Mitch McConnell of Kentucky. Reid appears to hope that his measure, which promises $2.7 trillion in spending cuts and would increase the debt limit enough to keep the government afloat past the 2012 elections, could emerge as the last viable option standing and could be modified with input from Republicans.

Those same Republicans blasted Reid's bill for $1 trillion in war-related savings they say are phony. But McConnell is emerging as a key figure in the endgame, and he sounded a conciliatory note in an appearance Tuesday.

"We need to get an outcome. And to get an outcome, a Republican House, a Democratic Senate and a Democratic president would have to reach an agreement," McConnell said. "So I'm prepared to accept something less than perfect, because perfect is not achievable."

One area of potential compromise could be how to treat the findings of a bipartisan congressional commission to identify further deficit reductions, especially in major health care programs such as Medicare and Medicaid. Both Reid and Boehner support the idea, though Boehner wants to make a future increase in the debt limit contingent on the proposed additional cuts being enacted into law.

Meanwhile, the clock was ticking down to next Tuesday's deadline to continue the government's borrowing powers and avert possible defaults on U.S. loans and obligations, like $23 billion worth of Social Security payments due Aug. 3. The Capitol's telephones were jammed after Obama urged the public to contact their representatives in his Monday night address.

Conservative bloggers and groups like the Club for Growth, which funds primary campaigns against Republicans it deems too squishy in their conservatism, denounced Boehner's bill as too weak. The U.S. Chamber of Commerce, closer to the GOP mainstream, urged support.

While Boehner searched for votes, some Americans seemed to edge closer to the notion that the Aug. 2 deadline might pass without a solution. The stock market fell again, although not dramatically. California planned to borrow about $5 billion from private investors as a hedge against a possible federal government default.

The White House spoke with veterans groups about what might happen to their benefits if a deal isn't reached. Obama has said he can't guarantee Social Security checks and payments to veterans and the disabled would go out on schedule.

Freshman Rep. Trey Gowdy, R-S.C., bristled at the idea that tea party-influenced newcomers are sheep-like ideologues willing to risk default.

"We're not a bunch of knuckle-dragging, mouth-breathing Neanderthals," Gowdy said. "We're interested in answering what we perceive to be the mandate, which is to stop the spending and change the way Washington handles money."

Gowdy said he was leaning against Boehner's proposal.

China train crash 'threatens' rail exports (AFP)

BEIJING (AFP) ? A fatal crash on China's high-speed train network could scuttle Beijing's ambitions to sell the technology overseas and could also hit its existing rail exports, analysts said Wednesday.

Shares in Chinese rail and train builders have fallen sharply since the accident which killed at least 39 people and injured 200, and raised questions over Beijing's rush to develop the world's biggest high-speed rail network.

Initial reports blamed Saturday's collision on a lightning strike that knocked out power to the first train, which was then rammed from behind by a second express, crushing some carriages and shunting others off a viaduct.

The incident has badly shaken public faith in the rail system, especially the high-speed network which has been plagued by corruption allegations and repeated delays caused by power shortages.

Experts say unanswered questions, including why the second train was not warned on time to stop, have exacerbated concern over the rail systems developed in China and could jeopardise future deals.

"There are already concerns overseas about the quality of some of this technology," Alistair Thornton, a senior analyst at research group IHS Global Insight, told AFP.

"I think this will make it very difficult for policymakers in the West to rely on China as a source."

Beijing -- keen to show off its technological prowess and growing wealth at home and abroad -- has been pushing to export high-speed train technology even though its own network only opened to passengers in 2007.

The Chinese government has poured large sums into developing the world's largest high-speed rail system, with 8,358 kilometres (5,193 miles) of track at the end of last year.

It is expected to exceed 13,000 kilometres by 2012 and 16,000 kilometres by 2020.

Observers said the accident would raise doubts about the quality of the traditional technology that still makes up the bulk of China's rail exports, as well as the newer high-speed equipment it is trying to sell abroad.

China is helping build high-speed links in Turkey, Venezuela and Saudi Arabia and last December CSR signed an agreement with US conglomerate General Electric to make high-speed trains in the United States.

But Atlantis Investment Research president Edwin Merner said China had "zero" chance in the next five to 10 years of exporting its high-speed trains and equipment -- even if it was originally based on Western technology.

"I think people would say 'your trains are unreliable and therefore your systems are not perfected so we don't want them'," Tokyo-based Merner told AFP.

"It just reconfirms that if you try to go too fast and if you talk big then probably something is wrong."

The companies behind China's rail network gained the right to use certain rail technology when they bought equipment from Western firms.

Chinese train builders CSR Corp and CNR Corp along with China Railway Group and China Railway Construction Corp acquired significant technology from industry giants such as Alstom, Bombardier and Siemens.

Now, they are battling those companies for a share of the overseas market.

CSR, which was involved in making both trains in last weekend's crash, had 13 billion yuan ($2.02 billion) in outstanding overseas contracts at the end of 2010, according to the company's annual report.

Chinese exports of locomotives, rolling stock, parts, tracks and signalling equipment reached $2.9 billion in 2009, down from $10.2 billion in 2008, according to the latest government data.

A breakdown for high-speed rail exports was not available

"The accident does not mean the end of high-speed, but it will force other countries to think more about whether they really need it and where they get those technologies," Ingrid Wei, an analyst at Credit Suisse, told AFP.

Shanghai-listed shares in CSR have fallen as much as 12.5 percent since the crash, while CNR fell as much as 13.8 percent as analysts warned the pace of railway construction was likely to slow down as China focused more on safety.

Merner said the disaster had exposed key flaws in China's railway system and it could take 20 years for local train and rail builders to convince foreign buyers their high-speed technology was safe.

"The construction -- even if the designs are very good -- depend on very reliable parts and Chinese parts technology leaves something to be wondered about," he said.

Watchdog bans airbrushed L'Oreal make-up adverts (AFP)

LONDON (AFP) ? The Advertising Standards Authority said Wednesday it had banned two adverts by French cosmetics giant L'Oreal over "misleading" airbrushed images of actress Julia Roberts and supermodel Christy Turlington.

L'Oreal, the world's largest cosmetics maker, had failed to prove that the photos used in its magazine adverts accurately showed the results of the products, the advertising watchdog said.

The ban follows a complaint by a British lawmaker about ads for L'Oreal's "Teint Miracle" foundation, promoted by Roberts for the Lancome brand, and ads for "The Eraser" foundation by Maybelline, featuring Turlington.

"We accept that digital manipulation is used in adverts but it has to be done in a truthful way," Advertising Standards Authority spokesman Matt Wilson said.

"In these particular adverts we were not satisfied that the post-production techniques have not exaggerated the benefits of the product."

L'Oreal defended the adverts, saying that they accurately showed the results the products could achieve.

It admitted post-production techniques had been used on the picture of Turlington to "lighten the skin, clean up make-up, reduce dark shadows and shading around the eyes, smooth the lips and darken the eyebrows".

Roberts has "naturally healthy and glowing skin", L'Oreal said, adding that the photo was taken by Mario Testino, well known for his flattering camera work.

But Jo Swinson, the lawmaker from the centrist Liberal Democrat party who made the complaint, said images like the "dishonest and misleading" ones featured in the adverts were "distorting our idea of beauty."

However, patents are no longer a measure of advanced technology. When Google tried to buy Nortel's patent portfolio for pi billion dollars it wasn't interested in the new ideas. They wanted weapons to use against Apple in a legal patent war. Apple isn't going directly after Google, but is indirectly?attacking?them by suing Android based mobile phone manufacturers such as HTC.

Unfortunately for Google, those patents were won by a coalition of?Apple, EMC, Ericsson, Microsoft, Research In Motion and Sony which spent over $4.5 billion dollars on them. In the 1990's, Microsoft was the top tech company and its competitors used anti-trust laws because they weren't able to compete against them in the market place. Today, Google is the top tech company* and its competitors are using intellectual property laws to contain its growth.?

Microsoft become much more involved with D.C. after it had to deal with anti-trust issues. If Google decides to put some of that pi-billion towards?stepping up its lobbying spending?then maybe it can help reform a broken system while protecting itself from businesses who are abusing the patent system because they are being beaten in the marketplace.? Regardless of what happens, now that the role of patents have changed?people should stop pointing to increasing patent issuance as evidence of innovation. ?It is evidence that more roadblocks are being put up against innovation. Economists looking to do studies should think about alternative metrics. Tyler Cowen likes to use studies about how the first invention (patent - there is difference, now more than ever) is happening at older ages and it means that the low hanging technological fruit has been picked. But?it doesn't mean that it is harder for young people to think up new ideas, it is more likely that it means that patent generation has become a more bureaucratic aspect of business which is undertaken by older non-inventors.?

Change in Custody | The Post-Divorce Chronicles

Changing the primary custody of a child generally requires a change in material circumstances of either the child(ren) or a person affected by the original custody order. Additionally the change sought must be ?in the best interest of the child?.

Determining a change in material cirumstances requires first that you establish the circumstances of the child(ren) or the persons affected by the original custody order at the time that original order was entered. That is your ?baseline? against which to measure the change.

After determining the baseline of circumstances, then you must determine how the circumstances have changed.? There is no magic list of what those changed circumstances must be.? The changes could be in the health or employment situation of the primary custodian of the child. A job transfer, working longer hours or a need to travel in employment could be a ?material change? in circumstances. Counter-productive behavior by the other parent, if new since the prior order, may be a material change in circumstances.? These could be addictions, criminal behavior, misbehavior, neglecting or abusing the child, heath issues (mental or physical) may be material changes.

Behavioral problems with the child may be ?materially? changed circumstances.? Issues with school attendance, grades, truancy, drug or alcohol use may be materially changed circumstances.

Find a competent family law attorney. Discuss the situation with that attorney. Start documenting the instances where you can show the changed circumstances. Make a list of people who are aware of the circumstances and how they have changed. This list could include friends, co-workers, teachers, health professionals, counselors, pastors?anyone who has observed the changes. If you merely discussed the changes with these people, they have no independent admissible knowledge of the actual changes. Their testimony would be limited to the fact that you discussed changes with them?not that the changes had actually occurred.

Determine how the situation could be improved if the change you want to make would actually happen. Courts don?t change custody for the mere sake of change.

The change you seek must be an improvement which would be in the best interest of the child.? For example, if your ex-spouse has primary custody of your children, but the children aren?t doing well in school and are frequently absent; you might think that changing the primary custody to you would be a positive improvement and in the best interest of the children. But, what if your business requres you to travel overseas several times a month for a week or more, what do you do? Who would care for your children when you travel? Who would insure the children did their homework, studied for their exams, and got up in the mornings to go to school?

What if you are in a relationship and have step-children in the house?? What if the step-children have behavioral problems?? Would a melded family work? Or would it create more problems?? Think about the situation that would exist if you did change the custody.

Occasionally there is no good answer to these situations where the cure is as bad as the disease.?? Don?t restrict your search for advice to only attorneys. There are licensed professional family counselors, psychologists and other consultants available.

If you do decide to seek a change of custody, try to discuss it first with the other parent. He or she might be aware that a change is needed. If a discussion won?t resolve the issue, then hire an experienced attorney.? Remember, even if you and the other parent can agree to a change of custody, it must be memorialized in a court order to be enforceable and valid.? Side deals between parents don?t count if one or the other changes his/her mind and decides to go to court.

If you do want to fight a change of custody, there are a variety of tools and legal strategies available to you.? Psychological examinations of the parties and the children, custody evaluations by third party professionals, social studies of the living arrangements at both homes, interviews of the children by the Court (Judge) with or without attorneys present, amicus or ad litem attorneys appointed by the Court to assist with the children?s side of the case are all available.? Yes, the children may have an attorney appointed to represent them in custody litigation. That attorney may be either an attorney ad litem or an amicus attorney (what I call an attorney ad litem on steroids).

The tools and legal strategies do cost money.? Remember a change of custody can turn out to be a full blown war rather than a skirmish.? Plan for war and hope for a skirmish.? You cannot successfully fight a war cheaply.? Talk to an experienced attorney. Figure out a budget.? Use the tools you need, not all the tools you want. Of all the tools, I?ve found an amicus attorney to be the best bang for the buck in custody litigation. The other tools are ?nice to have? but the amicus is essential; especially, if you can get the amicus on your side of the case.? That way you can double-team the other attorney.
